Service Agreement Overview
This Software as a Service Agreement governs the provision of Tide Education's cloud-based intervention tracking platform to educational institutions. By subscribing to our services, you agree to the terms and conditions set forth in this agreement.
Service Provision
Tide Education Ltd agrees to provide:
- Access to the Tide Education platform via web and mobile applications
- Secure cloud storage for your data
- Regular software updates and improvements
- Technical support during business hours
- Data backup and recovery services
- User training and onboarding assistance
Subscription Terms
Your subscription includes:
- Billing Period: Monthly or annual billing options available
- User Licences: Based on the number of students in your institution
- Payment Terms: Payment due within 30 days of invoice
- Renewal: Automatic renewal unless cancelled with 30 days notice
- Free Trial: 30-day trial period with full functionality
Data Ownership and Security
Your Data: You retain all ownership rights to your data. We act as a data processor on your behalf.
Our Commitments:
- Implement industry-standard security measures
- Encrypt data at rest and in transit
- Comply with UK GDPR and data protection laws
- Provide data export capabilities
- Delete data upon contract termination as requested
Service Level Agreement
We commit to providing:
- Availability: 99.5% uptime target (excluding scheduled maintenance)
- Support Response: Within 24 hours for standard issues
- Data Backup: Daily automated backups
- Maintenance Windows: Scheduled during off-peak hours with advance notice
- Security Updates: Applied promptly to address vulnerabilities
Customer Responsibilities
As a customer, you agree to:
- Provide accurate account and billing information
- Ensure users comply with acceptable use policies
- Maintain confidentiality of login credentials
- Report security concerns promptly
- Use the service in compliance with applicable laws
- Pay subscription fees in a timely manner
Warranties and Disclaimers
We warrant that:
- The service will perform substantially as described
- We will use commercially reasonable efforts to maintain service availability
- We will comply with applicable laws and regulations
Disclaimer: The service is provided "as is" and we disclaim all warranties not expressly stated in this agreement, to the extent permitted by law.
Termination
Either party may terminate this agreement:
- With 30 days written notice
- Immediately upon material breach by the other party
- For non-payment of fees after 30 days notice
Upon termination, we will provide you with the ability to export your data for up to 60 days.
